I must agree that stupid is not always the case, sometimes they are and sometimes they are not. I think the more appropriate wording would be evil. While there are exceptions to nearly every case, to break into someone's house and rob them, and then trip over something of theirs and sue them for your own clumsiness, usually requires that they be evil. The fact of the matter is, we cannot take away their rights to sue the owner of a house as it is their right. The real problem is the inept judges that rule in the criminals' favor. For, it is obvious that it is not the fault of the owner. The owner was in no way negligent. The criminal was not supposed to be there in the first place.
I feel the need to clear up a few things as I've been working with structured settlements for the last 2.5 years.
1) Many of the instances you hear where someone is breaking and entering and sue due to injury are made up. The only such case was when a homeowner shot and killed an unarmed intruder and was acquitted in criminal court but later sued by the criminals family in civil court and had to pay a large sum of money.
2) The sued parties do not come out of pocket, their insurance company does. Which is why insurance companies all over the country are going under, because of frivolous lawsuits.
3) In the case with the dog, that is a physical assault case and there's no possible way a US courtroom would hand a judgement to someone who illegally entered someones property, shot their dog, and got bit because of it. I assure you, that did not actually happen.
4) The US is in the process of passing a law where any injured party loses all claims of third party negligence when in the act of committing a crime. Hopefully it will be passed soon and this issue will not appear again.
Though seriously if Im out walking around in the night to ASDA with the pedo/rapist/murderer/psycho of questionable sanity vampy....who do I have to be afraid of? XD

They better pass that law about criminals not being able to sue because of injuries due to a crime. Though, I think the only ones who would vote against it are criminals, don't you think? Everyone else just doesn't want to get sued.
